1. Acceptance of Terms
Welcome to LotMore.ca ("LotMore", "we", "our", or "us"). By accessing or using our website, platform, software, tools, reports, APIs, 3D visualization services, zoning analysis tools, feasibility assessments, or related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms").
If you do not agree to these Terms, you must not use the Services.
You represent that you are at least the age of majority in your jurisdiction and legally capable of entering into binding agreements.
2. Description of Services
LotMore provides property research, zoning analysis, feasibility evaluation, planning insights, 3D visualizations, buildable envelope estimations, development potential assessments, and related informational tools for residential, commercial, and mixed-use properties.
The Services may include:
- Zoning and land-use information
- Parcel and lot data
- Building envelope calculations
- Development feasibility analysis
- Planning and policy interpretation
- 3D visualizations and massing studies
- Reports and downloadable documents
- AI-generated recommendations and insights
- Municipal and third-party data integrations
The Services are intended for informational and preliminary planning purposes only.
3. No Professional Advice
LotMore is not a substitute for professional architectural, engineering, legal, planning, surveying, environmental, financial, or construction advice.
Information provided through the Services:
- is general and informational in nature;
- may contain inaccuracies, omissions, or outdated information;
- does not constitute professional advice, approvals, permits, or certifications;
- should not be relied upon as the sole basis for development, investment, purchase, construction, or permitting decisions.
Users are solely responsible for independently verifying all information with licensed professionals and relevant government authorities before proceeding with any project.
Municipal regulations, zoning by-laws, official plans, overlays, policies, and development standards may change without notice.
4. Accuracy of Information
While we strive to provide accurate and up-to-date information, LotMore does not warrant or guarantee:
- the accuracy,
- completeness,
- reliability,
- legality,
- availability,
- suitability, or
- timeliness
of any data, calculations, renderings, reports, analyses, or recommendations.
Results generated by the platform are estimates only and may differ from actual municipal interpretations, approvals, or built outcomes.
You acknowledge that:
- zoning interpretation can vary by municipality and reviewer;
- automated feasibility assessments may not account for all site-specific conditions;
- development approvals are discretionary and subject to government review processes.
5. User Accounts
To access certain features, you may be required to create an account.
You agree to:
- provide accurate and current information;
- maintain the confidentiality of your login credentials;
- accept responsibility for all activities under your account.
You must not:
- share accounts without authorization;
- impersonate others;
- use automated scraping tools, bots, or unauthorized data extraction methods;
- interfere with platform security or functionality.
We reserve the right to suspend or terminate accounts at our discretion.
6. Payments and Subscriptions
Certain Services may require payment, subscription fees, or report purchases.
By purchasing paid Services, you agree that:
- all fees are payable in advance unless otherwise stated;
- fees may change at any time;
- subscriptions may automatically renew unless cancelled;
- taxes may apply.
Unless required by law, all purchases are non-refundable.
Subscriptions renew monthly until cancelled. You may cancel a subscription through your account billing portal. Cancellation stops future renewals but does not automatically refund the current billing period. Refunds may be considered case-by-case for billing errors, duplicate charges, or other circumstances required by law.
We may use third-party payment processors and are not responsible for their services or security practices.
7. Intellectual Property
All content, software, interfaces, graphics, reports, calculations, datasets, designs, branding, algorithms, visualizations, and platform functionality are owned by or licensed to LotMore and protected by intellectual property laws.
You may not:
- reproduce,
- copy,
- modify,
- distribute,
- resell,
- reverse engineer,
- scrape,
- commercially exploit, or
- create derivative works
from the Services without written permission.
Limited, non-exclusive, revocable access is granted solely for lawful personal or internal business use.
8. User Content
If you upload, submit, or provide content, including project details, property information, drawings, or feedback ("User Content"), you grant LotMore a non-exclusive, worldwide, royalty-free license to use, host, process, reproduce, and display such content for operating and improving the Services.
You represent that:
- you own or have rights to the User Content;
- the content does not violate laws or third-party rights.
We may remove content at our discretion.
9. Third-Party Data and Integrations
The Services may incorporate data from municipalities, public agencies, mapping providers, GIS systems, or third-party vendors.
Third-party data:
- may contain errors or omissions;
- may be subject to separate licenses or restrictions;
- may change without notice.
LotMore is not responsible for third-party services, data accuracy, outages, or licensing limitations.
10. AI-Generated Outputs
Certain features may use artificial intelligence or automated systems to generate reports, recommendations, summaries, feasibility analyses, or visualizations.
AI-generated outputs:
- may contain inaccuracies or incomplete information;
- are probabilistic and not guaranteed;
- should always be independently reviewed by qualified professionals.
You assume all risks associated with relying on AI-generated outputs.
11. Permitted Use
You agree to use the Services only for lawful purposes.
You must not:
- violate applicable laws or regulations;
- attempt unauthorized access;
- interfere with system operation;
- scrape or harvest data at scale;
- use the platform to compete with LotMore;
- misuse municipal or third-party data.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANIBUILD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY,
- FITNESS FOR A PARTICULAR PURPOSE,
- NON-INFRINGEMENT,
- ACCURACY,
- RELIABILITY,
- AVAILABILITY.
WE DO NOT GUARANTEE THAT:
- THE SERVICES WILL BE ERROR-FREE,
- RESULTS WILL BE ACCURATE,
- THE PLATFORM WILL BE UNINTERRUPTED,
- OR THAT DEVELOPMENT APPROVALS WILL BE OBTAINED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANIBUILD SHALL NOT BE LIABLE FOR:
- INDIRECT,
- INCIDENTAL,
- SPECIAL,
- CONSEQUENTIAL,
- EXEMPLARY, OR
- PUNITIVE DAMAGES,
INCLUDING LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR DEVELOPMENT COSTS.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO CANIBUILD IN THE PRECEDING TWELVE (12) MONTHS.
14. Indemnification
You agree to indemnify and hold harmless LotMore, its affiliates, directors, officers, employees, and partners from claims, liabilities, damages, losses, and expenses arising from:
- your use of the Services;
- your violation of these Terms;
- your reliance on platform outputs;
- your infringement of third-party rights.
15. Privacy
Your use of the Services is also governed by our Privacy Policy.
By using the Services, you consent to the collection, use, and processing of data in accordance with the Privacy Policy.
16. Suspension and Termination
We may suspend or terminate access to the Services at any time, with or without notice, including where:
- you violate these Terms;
- we suspect misuse or fraud;
- required by law;
- necessary for platform security or maintenance.
17. Changes to Services or Terms
We may modify:
- the Services,
- pricing,
- features,
- functionality, or
- these Terms
at any time.
Updated Terms become effective upon posting to the website. Continued use constitutes acceptance of revised Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms constitute the entire agreement between you and LotMore regarding the Services and supersede prior agreements or understandings.
